You must agree to all rules, terms and conditions to use the Daily Doubloons™ mobile application (the App). The Daily Doubloons™ App is comprised of various interfaces operated by Worldwide Activity, Inc. and dba as Daily Doubloons™
Please read this software license agreement (License) carefully before using the Daily Doubloons™ software (software). By using the software/ App / Website / Shopping Cart, you are agreeing to be bound by the terms of this License. If You do not agree to the terms of this License, do not use the software. If this software was accessed electronically, and you do not agree to the terms of this license, delete the App by clicking the delete button indicating that you disagree/decline.
Your current and continuing use of the App constitutes your agreement and acceptance without modification to all such Terms, Rules, Conditions, Notices and Legal Statements contained herein (the Terms), as presently states, or as amended, adjusted or updated.

Daily Doubloons™ Description:

Daily Doubloons™ is a business marketing promotional agency which uses a geo-caching style, real treasure hunt application, to generate and drive interest and promote the desired products and/or merchandise. The purpose of the Daily Doubloons™ App is for the Host to hide real valuables/treasures/prizes for Players to locate by using the Daily Doubloons™ App. Daily Doubloons™ App is a vessel which provides individuals and businesses with a platform to post their treasure hunt(s) on a worldwide map. Daily Doubloons™ is for those that want to create, promote and provide treasure hunts to those who want to search for and find treasure.

How Does Daily Doubloons™ work?

Daily Doubloons™ works by having one party, the Host creates a real-life, real-time treasure hunt for the other party, the Player the Host provides real treasures or prizes of monetary value, such as gift cards, cash, jewelry, coins or other valued items to the Player, for free. The Player follows the clues, prompts or other directions given by the Host, and finds/wins the Treasure and/or Prizes. It is vital to note that it is free, and costs absolutely nothing for hosts or Players to download the Daily Doubloons™ App. The only the cost is for the Host to purchase a treasure hunt package. The cost of the treasure hunt package varies between the cost for Individual Hosts, and for Business Hosts, based upon the difference in their use of the application. Additionally, the GPS location service is an optional item, and does also cost the Host to purchase, if they wish to provide that to their Player(s). The Host is paying for the service of the Daily Doubloons™ App to be provided for free to their player(s).
This means that there is absolutely no cost to the Player(s). The treasure hunt package is paid for by the Host, and the treasure provided to the Player must be 100% free. The only qualification to be able to receive the treasure is that the Player must follow the clues provided in the treasure hunt by their Host and find the treasure. At that point, the treasure belongs to the Player free and clear of all obligations.
There are two categories of Host: Individual Hosts and Business Hosts. Individual Hosts are individuals who have downloaded the Daily Doubloons™ App and used it to create a real-life treasure hunt for their family, friends or acquaintances.
Business Hosts are businesses/companies that have downloaded the Daily Doubloons™ App and used it as a marketing vessel to provide creative advertising, brand marketing and promotional events by creating a real-life treasure hunt for their customers, clients, or members to see, follow, and interact with. Additionally, Business Hosts are able to create or upload their Advertising Banners to display with each one of their clues/directions for Players to see, as an additional source of brand marketing.

What Does the User/ Host Gain by using Daily Doubloons™?

As an Individual Host, users gain the opportunity to provide a fun/memorable experience to their family, friends, significant other, and acquaintances.
Our niche is promoting/providing a creative, interactive marketing service to retailers, businesses, and those providing products and services. As such, Business Hosts use Daily Doubloons™ as part of a developed marketing strategy for their business/company, while providing a fun, memorable experience to their customers and clientele. Additionally, this use of the business marketing promotional agency that is Daily Doubloons™ App allows Business Hosts to reach new customers and expand their client base.
All Hosts, both Business Hosts and Individual Hosts, have the opportunity to use something we call the Doubloons Code to provide themselves with an immediate notification that their treasure has been found. This is done by providing the Doubloons Code generated by the Daily Doubloons™ App when the treasure hunt was created, to the winning Player. This can be done by having it provided as a clue in the hunt, by leaving it written on a piece of paper or other material with the Treasure, etc. The Player will then enter this Doubloons Code to validate their winning/finding of the Treasure, and to alert the Host that the treasure has been found. Additionally, the use of the Doubloons Code also allows for winning Players to be entered into a database of qualified participants, to be invited to participate in activities and events sponsored and provided by Daily Doubloons™ App.

What Does the User/ Player Gain by using Daily Doubloons™?

As a Player, users gain the opportunity to search for treasure and prizes of real monetary value. They receive these prizes and treasures for free, after a fun Treasure Hunt to find them. Additionally, winning Players who have utilized the Doubloons Code provided by the Host of their treasure hunt have the opportunity to be entered into a database of qualified participants, to be invited to participate in activities and events sponsored and provided by Daily Doubloons™ App.

What is the Demographic of Daily Doubloons™?

The Daily Doubloons™ Demographic is anyone, including individuals, single persons, married persons, families, groups, businesses, and organizations.
The niche of this App is that all Treasures/Prizes are Real Treasure Hunts of Real Value, which are required to be provided 100% free to the Players, with no caveats or stipulations.
Age Limits/ Restrictions: Only Players who are 18 years old or older are allowed to participate in Open Doubloons Treasure Hunts. Only Hosts who are 18 years old or older can choose to Host Open Doubloons Treasure Hunts. Younger Players and Hosts are restricted to participation in Exclusive Doubloons Treasure Hunts. Additionally, Players younger than 18 are not eligible for entry into the Daily Doubloons™ Promotional Database for future activities, events, and treasure hunts sponsored exclusively by Daily Doubloons™ App.
Players younger than 18 can play and win the prizes from Exclusive Doubloons Treasure Hunts, but they are not eligible for entry or participation in Open Doubloons Treasure Hunts, or for entry into the Database of qualified participants that are eligible to receive invitations from Daily Doubloons™ App for future events, activities, and treasure hunts.
How to Use the Daily Doubloons™ App: The Daily Doubloons™ App is free for both the Host and the Player to download. The Host purchases a treasure hunt package, creates a treasure hunt, and provides the treasure(s) and prize(s) 100% free to the Player. The Player follows the clues and directions provided by the Host, through the Daily Doubloons™ App, and searches for the treasures and/or prizes hidden by the Host. When the Player finds the treasure(s), they obtain the treasure/prize.
Hosts may also choose to purchase a Doubloons Locator, which allows them to provide GPS notifications to Players when they are physically close to the Treasure. Each Treasure Hunt is given a name and assigned a Doubloons Code when created. The Host is encouraged (but not required), to place or hide the Doubloons Code with the treasure, where it is easy for Players to find. The Doubloons Code provides instant feedback when each treasure is found, as Players input the Doubloons Code into the Daily Doubloons™ App to claim their treasure. This also verifies the identity of the winning Player, who will then be known as a Doublooner. All Doublooners are entered into a database exclusive to eligible winning Players, where they will be eligible for invitation to participate in periodical treasure hunts, activities and other events provided solely by Daily Doubloons™ App and not associated with any business or individual host.

Definitions:

• Host: User of the Daily Doubloons™ App to create treasure hunt(s), and provider of Real Monetary Value treasure, provided free to the Player. Host posts clues, riddles, maps, pictures, videos, GPS coordinates and any other creative clues to Players.
• Individual Hosts: Individuals who have downloaded the Daily Doubloons™ App and used it to create private treasure hunts for their personal family, friends and acquaintances. These private treasure hunts are called Exclusive Doubloons. Individual Hosts can post Exclusive Doubloons Treasure Hunts, or Open Doubloons Treasure Hunts if they are over 18 years old.
• Business Hosts: Any business: large, small, privately owned, individual or sole proprietor, public or corporation, S corporation or LLC of any kind or size, businesses or companies, that has downloaded the Daily Doubloons™ App, and used it to create treasure hunts using the Daily Doubloons™ App for promotional and advertising purposes. Business Hosts can post Exclusive Doubloons Treasure hunts which are real-life treasure hunts posted only for their clients/ members/ customers. These are invitation only and cannot be followed by the general public.
Business Hosts can also post Open Doubloons Treasure Hunts which are real-life treasure hunts of real monetary value, and are open to the general public, and the world. They are available to all users of the Daily Doubloons™ App, anywhere in the world, and are Pinned to the public Maps Page on the Daily Doubloons™ App for all Users to search for and see. Each time a new clue is sent out by the Business Host of an Open Doubloons Treasure Hunt, a notification is sent to all Players who are following that hunt and displays an Advertising Banner for the Business Hosts Company. Business Hosts may choose to post Physical Open Doubloons, or Virtual Open Doubloons treasure hunts on the Daily Doubloons™ App Maps Page.
• Player: Personal user who has downloaded the Daily Doubloons™ App, for the purpose of seeking/searching for treasure hunts provided by Host. Treasures and Prizes are 100% free to Player(s). Players may follow Exclusive Doubloons, if invited by the Host, or follow any Publicly Posted, Open Doubloon Treasure hunt, whether local, national or worldwide. Players who follow Open Doubloons must be 18 years of age or older.
• Doubloons Buccaneer: The title of a winning Player, who has found treasure from either an Individually Hosted treasure hunt, or from an Open Doubloons treasure hunt. Doubloons Buccaneers are the winning Players who make up the database of winning Players from which Daily Doubloons™ Promotional Drawings are done. Only Doubloons Buccaneers who are 18+ are entered into the Daily Doubloons™ Promotional Database. As mentioned, No purchase is necessary to participate in promotional drawings or win any prize. These giveaways are void where prohibited and subject to applicable laws and eligibility requirements.
• Pins: Pins are the representation of the physical location or area where a treasure hunt is located. They represent the Starting Point of the Treasure Hunt. For Physical Open Doubloons, on the Maps Page, there will be treasure chest icons, which open to reveal information about the Host, and the treasure hunt. Pins are Not the location of, or the exact spot where the Treasure is located. For Virtual Doubloons or virtual treasure hunts, Pins are represented on the Maps Page by a pirate icon. Pins are essential to all treasure hunts because they represent the starting point of the treasure hunt, and the marketed area that the Host has chosen as the location of a physical treasure hunt. Pins are only for Open Doubloons Treasure Hunts.
• Fence: The Fence is the physical boundary area of the Treasure Hunt, as decided by the Host. It is decided by the Host when the Treasure Hunt is designed. The Pin, which is the Starting Point, is located inside the Fence. The Fence is only applicable to Physical Treasure Hunts, because it designates the physical location, and boundaries, of a physical treasure hunt.
• Physical Treasure Hunts: Real Physical Treasure Hunts created by the Host, and posted on the Daily Doubloons™ App. The Treasure MUST be placed and hidden in a physical location somewhere in the world, indoors or outdoors, and MUST have a Treasure of real monetary value in it. Physical Treasure Hunts may be Exclusive Doubloons Hunts, and be open only to invited Players, or they may be Open Doubloons Hunts, and be open to the Public, to all Players on the Daily Doubloons™ App.
• Virtual Treasure Hunts: Real-time virtual treasure hunts that take place within the Daily Doubloons™ App. Players compete to solve puzzles, find images or other virtual prizes hidden in pictures or other settings, as designed by the Host. Every Player that finds the prize or solves the Virtual Doubloon Hunt receives a treasure/ prize of monetary value, such as a loaded gift card, money sent to their PayPal or Venmo account, or other forms of Real, Cash Value Treasure. All treasure hunts are skill-based, free to enter, and do not involve any form of gambling or chance-based mechanics.
• Exclusive Doubloons: Exclusive Doubloons are treasure hunts open only to Players invited by the Host. For a Player to join an Exclusive Doubloons Hunt, they must have the name of the hunt, and a password to join, both of which are provided by the Host of the treasure hunt. Exclusive Doubloons treasure hunts can be both physical treasure hunts, or virtual treasure hunts. The premise of Exclusive Doubloons is that they are only open to invited Players. Exclusive Doubloons may also be posted in the desired language, by the Host, because they are closed groups of only invited Players.
• Virtual Doubloons: Virtual Doubloons are real-time virtual treasure hunts that take place within the Daily Doubloons™ App. Players compete to solve puzzles, find images or other virtual prizes hidden in pictures or other settings, as designed by the Host. Virtual Doubloons may be Exclusive Hunts, and open only to invited Players, or they may be Open Hunts, and be open to the Public, to all Players on the Daily Doubloons™ App. All winning Players will receive a treasure/prize of Real Monetary Value. There is no purchase required in order to win.
• Open Doubloons: Open Doubloons are a Business Host niche, and are live treasure hunts open to the public, and all Players in a specific geographical area, anywhere in the world. Both Business Hosts and Individual Hosts who are 18+ can post Open Doubloons. They do not require a password to join. They can be searched for by any Player on the Maps page of the Daily Doubloons™ App. They can also be followed by any Player, who is 18+. Open Doubloons can be either physical treasure hunts or virtual treasure hunts, but they are always open to all Players, and can be seen and searched for on the Maps page of the Daily Doubloons™ App. Only Open Doubloons appear on the Maps Page.
• Treasures/ Prizes: Daily Doubloons™ Treasures and Prizes MUST be Real Treasure of Real Monetary Value. This includes, but is not limited to: Real Gold, Silver, Jewels, Jewelry, Precious Metals, Gems, Coins, Cash, Pre-paid Credit Cards, Loaded Gift Cards, Merchandise, Cars or Automobiles, Gifts, Real Property, or the Redemption of Something of Real Monetary Value, such as redeemable certificates for trips or vacations, pre-paid airfare, or other packages. These Treasures must be 100% free to the Player, and cannot include discount coupons, discounts for purchase, percentages off purchase, buy-one-get-one-free, nor may they require condo presentations, inspections or other sales or marketing presentations. There may be absolutely NO STRINGS ATTACHED! TREASURE IS 100% FREE TO THE PLAYER!! There is no purchase required in order to win.

Hosting:

For the Purposes of the Daily Doubloons™ App, there are two categories of Hosts, Individual Hosts, and Business Hosts.
Both Business and Individual Hosts purchase a treasure hunt package, create and supply the treasure and the treasure hunt and give daily, hourly or periodical posts for the Daily Doubloons™ App, which provides the clues to the Player(s) . These clues will be provided as notifications to the Player(s). Also, both Business and Individual Hosts may choose to hide a Doubloons Code with their treasure. This has several benefits: 1. Instant Feedback when each treasure is found, as Players input the Doubloons Code into the Daily Doubloons™ App, to claim their treasure, 2. Verification of the status of the winning Player, , 3. Application of the winning Player into a database for future drawings and promotions. This is only for Players who are 18 years old or older.
Hosts may give daily, or even hourly posts with clues, hints, and other directions from the Daily Doubloons™ App to the Players. Clues may include, but are not limited to: riddles, rhymes, codes, puzzles, cryptic clues, stories, music, questions requiring an answer, facts, keywords, simple wordplay, crossword puzzles, sequential or non-sequential clues, locations, GPS coordinates, maps, pictures, videos, Morse Code, Braille, Sign Language (in the target language), Pirate’s Codes, and other forms of creative instructions to direct Players to the Treasure.
• Individual Hosts: are Individuals who have downloaded the Daily Doubloons™ App, and created treasure hunts for their personal family, friends, and acquaintances. Individual Hosts can post Exclusive Doubloons, or they may choose to post Open Doubloons. Exclusive Doubloons are private treasure hunts open only to invited Players of the Host. These private treasure hunts (Exclusive Doubloons) may be either physical treasure hunts (Physical Doubloons) with notifications and clues for their invited Players to follow, or they may be Virtual Doubloons- Virtual treasure hunts- that are live on the Daily Doubloons™ App for their invited Players to follow. Open Doubloons are live treasure hunts open to all Players who have downloaded the Daily Doubloons™ App. They are accessible from the main Maps Page for all Players on the Daily Doubloons™ App. Open Doubloons hunts can only be posted by Hosts 18 years and older. Open Doubloons can also only be player by Players 18 years and older. Open Doubloons can also be Physical Doubloons, ie. Physical Open Doubloons, live, physical treasure hunts, open to all Players in a geographic region, or they can be Virtual Doubloons, and be Virtual treasure hunts, posted live in the Daily Doubloons™ App, and available to ALL Players across the world.
• Business Hosts: are any business: large, small, privately owned, individual or sole proprietor, public or corporation, S corporation or LLC of any kind or size, businesses or companies, that has downloaded the Daily Doubloons™ App, and used it to create treasure hunts using the Daily Doubloons™ App for promotional and advertising purposes, for their clients/ customers, and to increase their customer base and create new methods of advertising.
Business Hosts have a Profile Advertising Banner accompanying their treasure hunt(s) for Players to see. Each time a Business Host posts a new clue the Player(s) will see the Host’s advertising banner and the accompanying new clue.
For Business Hosts there are two categories of Treasure Hunt available to post: Exclusive Doubloons and Open Doubloons.
Business Hosts that post Exclusive Doubloons Hunts are limiting the hunt to their customers, clients, resort guests, employees, and members, who have an invitation, the Name of the Treasure hunt, and the password to join. These Exclusive Hunts may be physical, live, in person treasure hunts (Physical Doubloons), or they may be Virtual hunts (Virtual Doubloons), and be open to these same invited Players to search for in the Daily Doubloons™ App.
Open Doubloons are a Business Host niche, and are real, live, real-time treasure hunts open to the public, and all Players in a specific geographical area, anywhere in the world. They do not require a password to join. They can be searched for by any Player on the Maps page of the Daily Doubloons™ App. They can also be followed by any Player. Open Doubloons can be either physical treasure hunts or virtual treasure hunts, but they are always open to all Players, and can be seen and searched for on the Maps page of the Daily Doubloons™ App.
Open Doubloons hunts can also be previously hidden treasures, as the Host does not have to be physically present to post the Treasure Hunt. Open Doubloons hunts are Pinned to the Maps page, and all Players who have downloaded the Daily Doubloons™ App can search for Pins hidden by Business Hosts in a specific area. These are posted as Treasure Chests, which open to have the Business Name, and Advertising Banner, name of the treasure hunt, a small description of the treasure, and an optional picture of the treasure. Players who want to join an Open Doubloons hunt then click onto and choose to subscribe, follow, or get notifications for that hunt. If Players do not enable notifications, and do not follow the Open Doubloons hunt, they will not receive updates, posted clues, or other notifications, to help them find the treasure.
Open Doubloons can only be followed by Players 18 years old or older.
Exclusive Doubloons:
Exclusive Doubloons are treasure hunts open only to Players invited by the Host. For a Player to join an Exclusive Doubloons Hunt, they must have the name of the hunt, and a password to join, both of which are provided by the Host of the treasure hunt. Exclusive Doubloons treasure hunts can be both physical treasure hunts, or virtual treasure hunts.
Business Hosts can also post Exclusive Doubloons treasure hunts. Business Hosts that post Exclusive Doubloons Hunts are limiting the hunt to their customers, clients, resort guests, employees, and members, who have an invitation, the Name of the Treasure hunt, and the password to join. These Exclusive Hunts may be physical, live, in person treasure hunts, or they may be Virtual hunts (Virtual Doubloons), and be open to these same invited Players to search for in the Daily Doubloons™ App.
Virtual Doubloons:
Virtual Doubloons are Virtual treasure hunts that take place in real-time, within the Daily Doubloons™ App. Both Individual Hosts and Business Hosts can post Virtual Doubloons Hunts. Hosts can post either Exclusive Virtual Doubloons, or Open Virtual Doubloons. Exclusive Virtual Doubloons are, again, open only to invited Players, while Open Virtual Doubloons are publicly posted Virtual treasure hunts, open to anyone on the Daily Doubloons™ App who is 18+.
The Host will post the description and value of the treasure at the beginning of the Virtual Doubloon treasure hunt. The Host will hide a coin of any size, shape, value, color or kind in any area, location or place. The Host will then upload a picture that has the coin hidden in it into the Daily Doubloons™ App. The Host will then enlarge the picture, locate the hidden coin in the picture, and create a very tight circle around the coin. Once they save this image in the Daily Doubloons™ App, they have created a Virtual Doubloons hunt. Hosts have the option to set a time limit on the Virtual Doubloons hunt, or to set time restraints, which only allow Players to search during a certain window of time each day.
Once the Host has placed the coin, and taken the picture, the coin does not have to be left there. This is a virtual hunt on the Daily Doubloons™ App. The Host does not have to be in the physical location of the picture to post the hunt. Hosts may choose images from vacations, trips, or daily life, and post them as Virtual Doubloons Hunts. The requirement is that a small part of the coin MUST be visible in the picture that is posted. However, that visible piece may be disguised with creative lighting, use of natural materials, by choosing coins that blend in with the surroundings, and other creative methods to make for an interesting Virtual Doubloons treasure hunt.
Business Hosts may post Open Virtual Doubloons hunts in their home areas, or in other areas, such as where they have visited or vacationed, in order to advertise and promote their businesses. Business Hosts are invited to hide a coin in their inventory, products, store display or services, and take a picture. This will serve as an advertisement, as Players must enlarge, and search through the image of business inventory, products and/or services to find the hidden coin.
Every Player that finds and marks the Virtual Doubloons treasure hunt correctly will win the treasure, as well as being entered into the Daily Doubloons™ database for future promotional prizes and events, if they are over 18. No purchase is necessary to participate in promotional drawings or win any prize. These giveaways are void where prohibited and subject to applicable laws and eligibility requirements.

Doubloons Code:

The Doubloons Code plays a large part in the Daily Doubloons™ App. Every time an Individual or Business Host create a Treasure hunt, and give it a name, that treasure hunt is automatically assigned a Doubloons Code that identifies only that treasure. It is like a fingerprint or DNA: an alpha-numeric identification code unique to each specific treasure hunt. The Doubloons Code is made up of a series of letters and numbers that are automatically generated by the Daily Doubloons™ App and will never be repeated or duplicated again. Every time a Host creates a Treasure Hunt, they are strongly encouraged to leave the Doubloons Code in a very visible spot with their treasure. The Player who finds the treasure, and the Doubloons Code, must then input the code into the Daily Doubloons™ App. The Daily Doubloons™ App will then notify the Host that the treasure has been found, will recognize the Player as the Winner/Finder of the treasure, (this is also called a ˜Doubloons Buccaneer™), and place the Player into the Daily Doubloons™ database to be eligible for future promotional drawings, prizes, treasures, and travel giveaways. Every time a Player finds a treasure and inputs the accompanying Doubloons Code into the Daily Doubloons™ App, they will receive another entry into the Daily Doubloons™ Promotional Event Database. Therefore, Players who win/find multiple treasures, and input the corresponding Doubloons Codes can have multiple entries in the database.
Entry into the Daily Doubloons™ Promotional Database is contingent on the Player being 18 years old or older. Younger winning Players are not eligible for entry. Nor are they eligible for promotional drawings, prizes, etc.

Doubloons Locator:

Both Business Hosts, and Individual Hosts have the option to purchase the Doubloons Locator for their physical treasure hunts. The Doubloons Locator is a GPS notification system that the Host may choose, as they are setting up their treasure hunt, and that they activate, once they have placed their Treasure(s) into the desired location. The Host will then place their phone over top of where the hidden Treasure is located, login to the Daily Doubloons™ App, go to the Doubloons Locator frame, and Activate the Doubloons Locator. The Daily Doubloons™ App will save the GPS location of the treasure(s). When a Player gets within 15 feet, or the determined distance, as chosen by the Host, of the Treasure, the Daily Doubloons™ Locator will sound, by playing ˜Pirate Music™ on the Players phone to notify them that they are very close to the Treasure.
The Doubloons Locator activation is only saved and activated for Players who are Followers of, and have turned on Notifications for, this particular treasure hunt. No other Players will get notifications on their devices, even if they are standing right on top of the treasure. Therefore, it is very important that Players are made aware that they need to Follow, and turn Notifications on, for the Treasure Hunts they want to participate in, or they will not receive vital clues to find the treasure.

Maps Page, Pinning, Fences:

• Maps Page
The Maps Page in the Daily Doubloons™ App is where Players can search for Open Doubloons Treasure hunts. Players can choose a geographical area to search and then see Pins from the Hosts of Locations where Open Treasure hunts are. Players can then click onto a Pin, to find more information about that specific treasure hunt, and to choose to follow, and/or receive notifications for that specific treasure hunt. ONLY Open Doubloons Treasure Hunts are displayed on the Maps Page.
• Pins
Pins designate the area of a treasure hunt on the Daily Doubloons™ Maps Page. When the Host is filling out the forms to create their Physical Treasure Hunt, they will Pin the location. The Pin represents the area/location where the treasure is, but is not the location of, or the exact spot where the treasure is located. The Pin is placed in a spot where the Host wants the Players to see their hunt. The Pin represents the starting point for the Treasure Hunt. Pinning is an essential component of Open Doubloons Hunts, because the ˜Pin™ on the map shows the marked area where the treasure hunt is, so the Player knows where to start searching. Business Hosts posting in Open Doubloons Hunts have the Pins visible on the World map, to All Players. For Open Doubloons Treasure Hunts, the Pin may be anywhere in the world where the Host has hidden treasure and wants to open a Physical Treasure Hunt. This hunt does not have to be only in a Hosts local area, or location. Hosts can hide treasures, and then later open up a hunt to promote their business, to advertise their services, and to draw attention from the public with an Open Doubloons Hunt.
On the Maps page, Players will see two different icons for Pins. Treasure Chest shaped Pins represent all the Open Doubloons PHYSICAL Treasure Hunts in that specific area. Pirate icon shaped Pins represent all the Open Doubloons VIRTUAL Treasure Hunts in that specific area. When the Player clicks on a Treasure Chest Pin (i.e. the Treasure Chest icon), the treasure chest will open, and display the name of the Business Host, their advertising banner, the name of the Treasure Hunt, a small description of the treasure, and an optional picture of the treasure. The same thing will happen when a Player clicks on a Pirate icon Pin ; the name of the Business Host will be displayed, with the Hosts Advertising Banner, and a description of the treasure to be won for finding the hidden coin in the Virtual Treasure hunt. At this point the Player chooses to subscribe, follow, and get notifications from that specific treasure hunt, or to exit that specific hunt, and choose another one.
• Fences
After creating a Pin, for the starting point of the hunt, the Host will then create a Fence, and ˜fence in™ the area or perimeter of where the Treasure Hunt will be taking place. The entirety of the Physical Treasure Hunt will be inside the Fence. The Fence represents where the treasure is hidden and should include the Pin inside it. The Host will place dots around the area where they want the Fence to be. The Daily Doubloons™ App will create the Fence as soon as the Host hits the ˜Save™ button.
The Fence may be any size or any shape. It may follow a street, or any direction on the map. The Fence may be in the city or country where the Host plans to show the Player the parameters or general location of where the treasure may be. When the Player follows the Host’s Treasure Hunt and is directed to the Clues, the Player will first see the Fenced In area, which are the set boundaries of the Treasure Hunt. At this point, the Player has already chosen to follow this specific treasure hunt, and will see the Fence, the Pin, for the starting point, and any and all clues that are sent out to the followers of the Treasure Hunt.
• Players
Players are persons who have downloaded the Daily Doubloons™ App, and are seeking clues, directions or other posted information, provided by a Host, to find treasure, gifts, money or other valuables. Downloading the Daily Doubloons™ App is 100% free to the Player. Treasure hunting is also free to the Player. All Treasures are provided free to the Player and must be of real monetary value. This includes cash prizes, loaded gift and credit cards, jewelry, gifts, and other valuable prizes. If you could receive it as a really nice gift, it can be a treasure you could win, if you find it!
There are two categories of Player on the Daily Doubloons™ App: Exclusive Doubloons Players, and Open Doubloons Players.
Exclusive Doubloons Players are Players who have been specifically invited to the Treasure Hunt they are participating in. This can be because the Host of their Treasure Hunt is a family member, friend, or acquaintance who has invited them, or because they are members of a group, guests at a hotel or resort, or are customers of a business, and the Business Host of their Treasure Hunt has invited them. To join and follow an Exclusive Doubloons Treasure Hunt, Players must have the name of the Treasure Hunt, and the password to login. Only Players with the password are invited and able to participate in that specific Exclusive Doubloons Treasure Hunt. Within the criteria of Exclusive Doubloons, Treasure Hunts can then be further refined by being live, physical treasure hunts (Physical Doubloons), where the Player(s) must search specific areas for clues and treasures, and find/win the physical Treasure at the end of the hunt. Or they can be Virtual Treasure Hunts (Virtual Doubloons). Virtual Doubloons are real-time virtual treasure hunts that take place within the Daily Doubloons™ App. Players compete to solve puzzles, find images or other virtual prizes hidden in pictures or other settings, as designed by the Host. Every Player that finds the prize or solves the Virtual Doubloon Hunt receives a treasure/ prize of monetary value, such as a loaded gift card, money sent to their PayPal or Venmo account, or other forms of Real, Cash Value Treasure. All treasure hunts are skill-based, free to enter, and do not involve any form of gambling or chance-based mechanics.
Open Doubloons Players are Players who have downloaded the Daily Doubloons™ App, and have gotten onto the Maps page, and searched for Pinned treasure hunts in the area that they are interested in. Open Doubloons are only open to Players who are 18+. Younger Players will not be allowed to join/follow Open Doubloons Hunts.
Open Doubloons Treasure Hunts are publicly posted, and are open to all Players on the Daily Doubloons™ App. They do not require a password. They can be either Physical treasure hunts, or Virtual Doubloons Hunts. When Players search for Pinned Treasure Hunts on the Maps page, they will see two different icons: Treasure Chests, and Pirates. Treasure Chests icons are Pins for Physical treasure hunts. The Treasure Chest Pins open when clicked on to show the name of the Business Host of the treasure hunt, the Business Hosts™ Advertising Banner, the name of the Treasure Hunt, a small description of the Treasure, and an optional picture of the Treasure. Players must choose to subscribe, follow, and turn on notifications for That specific treasure hunt in order to receive notifications and clues. If Players do not choose to follow, and turn on notifications for a specific treasure hunt, they will not receive updates, notifications and new clues when they are posted. Additionally, for Physical Open Doubloons Treasure Hunts, Players who have not followed or turned on notifications will not receive access to the Doubloons Locator - A GPS notification system that will alert Players when they are within a certain distance of the physical treasure.
The Pirate icons are Pins for Virtual Treasure Hunts (Virtual Doubloons). When the Pirate Pin is clicked on, the name of the Business Host will be displayed, with the Host™s Advertising Banner, and a description of the treasure to be won for finding the hidden coin in the Virtual Treasure hunt. At this point the Player chooses to subscribe, follow, and get notifications from that specific treasure hunt, or to exit that specific hunt, and choose another one.

Promotional Drawings/ Travel Give-Aways:

Promotional Drawings, Travel Give-Aways, and other Promotional prizes are only available to eligible Players who are 18 years older or older. They are not available to players who are under the age of 18.
The information from every Player (18+) that inputs the Doubloons Code found with the Treasure they won into the Daily Doubloons™ App is entered into a database of all eligible winning Players. Younger Players (under 18) are not eligible for entry into the Daily Doubloons™ Promotional Database.
The winning Players (18+) who are entered into the database are known as Doublooners. The database of Doublooners will be used by Daily Doubloons™ App to invite these previously winning Players to participate in future promotional events, drawings, and treasure hunts, sponsored solely by Daily Doubloons™ App, and not related to any previous Individual Host or Business Host in any way. These promotional events may include activities such as give-aways of prizes, treasures, and even travel vouchers.
There are restrictions for travel give-aways. These are based on the type of travel and are determined by the companies that provide the travel services. Cruises require single passengers to be either 25 years of ages, or older. Cruises also require married passengers to be 18 years of age or older. Therefore, if the Daily Doubloons™ Promotional Event Drawing is for a cruise, the winning player must be either a single person of 25 years of age, or a legally married person of 18 years of age.
All winners must be 18 years of age or older to redeem any Promotional Drawings/ Travel Prizes.
All Travel Prices do not have a dollar value attached unless specified in the promotion. The winner must accept the Travel to redeem the value of the travel prize. The Winner of a Travel Prize/Travel Package may not redeem any monetary value or any money in place of the travel prize. The Winner MUST take the physical trip for which the travel package is indicated. The Travel must take place within one (1) calendar year from the time of the drawing, or the travel prize will be forfeited, including any monetary value thereof. The Travel must be booked through Morris Columbus Travel of Utah.
The Travel must be both booked, and the physical Travel taken within one (1) calendar year from the time of the drawing. If the winner of the Travel does not redeem, book, and Travel within one (1) calendar year from the time of the drawing, the Winner will be forfeit the Travel Prize, which will be automatically void. The Travel Prize is non-transferable. All Daily Doubloons™ Promotional Drawings are final, but they do include a second runner up. If the winner of the Daily Doubloons™ Promotional Travel Prize does not redeem, book, and undertake their Travel Prize within one (1) calendar year from the time of the drawing, the Travel Prize will be awarded to the Second Runner-Up. If the Second Runner-Up is awarded the Daily Doubloons™ Promotional Travel Prize, they will also be subject to the rules, and restrictions associated with the Travel Prize, and must also redeem, book and undertake the Travel Package within one (1) calendar year of the conferral of the Travel Prize.
Should the Second Runner-Up not redeem, book, or undertake the Travel Prize within one (1) calendar year from the date of the award, the award will be forfeit, and the Travel Prize will be deemed null and void. The value of the Travel Prize will be returned to Daily Doubloons™, and they may, at their sole discretion, reinvest the monies and/or value of the Travel Prize back into the Daily Doubloons™ Promotional Event, or into other areas of Daily Doubloons™.

Treasures:

Daily Doubloons™ Treasures MUST be Real Treasure of Real Monetary Value. This includes, but is not limited to: Real Gold, Silver, Jewels, Jewelry, Precious Metals, Gems, Coins, Cash, Pre-paid Credit Cards, Loaded Gift Cards, Merchandise, Cars or Automobiles, Gifts, Real Property or Redemption of Something of Real Monetary Value, such as redeemable certificates for trips or vacations, pre-paid airfare, or other packages. These Treasures must be 100% free to the Player, and cannot include discount coupons, discounts for purchase, percentages off purchase, buy-one-get-one-free, nor may they require condo presentations, inspections or other sales or marketing presentations. There may be absolutely NO STRINGS ATTACHED! TREASURE IS 100% FREE TO THE PLAYER!! There is no purchase required in order to win.

Video Release Disclosure: All Players that choose to follow any publicly posted Treasure Hunt (Open Doubloons) offered by any Host or by Daily Doubloons™, understand that they may be subject to Promotional Videos of them finding the Treasure, and their reaction. Host(s) or Daily Doubloons™ may record video footage and/or take pictures of the Player(s) that find and redeem Treasure. The Host(s) may use this video footage and/or pictures without obstruction from the Player(s). By participating in publicly posted treasure hunts (Open Doubloons), you may be photographed or recorded for promotional purposes. If you wish to opt out of this, please contact our support team prior to participation within the menu of the app.

Safety: Hosts should NOT hide Treasure in dangerous, or potentially unsafe locations such as back alleys, unsafe areas of a city/town, or in terrain that could cause harm, injury, or otherwise place Players into uncertain or hazardous situations. Players should assume that Treasures are not hidden in dangerous or potentially unsafe locations. However, Players must use caution and their own judgement to examine areas and choose not to follow clues that they deem may be hazardous or unwise to follow.

Philanthropy: A portion of the proceeds from Daily Doubloons™ will be donated to four (4) charities around the world. One of these will be a roving charity, which will allow us to donate based on current world events and needs. As a user of Daily Doubloons™ you can know that some of your fun will also help benefit good causes, and people in need, around the world. Users of Daily Doubloons™ do not have the option to choose the charities that are donated to. The decision of which charities are donated to is solely at the discretion of Daily Doubloons™.
Discretionary Statement: Player acknowledges that they play at their own risk. The Daily Doubloons™ App is used 100% at the discretion and risk of the Player. You must agree that you will NOT sue Daily Doubloons™ App, or our website, or our parent company World Wide Activity, Inc., for any reason, action, use or liability of any kind. Daily Doubloons™ is not responsible if the Host does not send the money or treasure promised in Virtual Doubloons, or if the treasure is not as promised or advertised in the Physical treasure hunt. Daily Doubloons™ App will Not pursue the Host, but we may ban them from posting future treasure hunts and provide a review that may control the outcome.

Host and Player agree to follow all rules and regulations, as stated in these Terms and Conditions, in order to be a Host or a Player on the Daily Doubloons™ App.

The Daily Doubloons™ Mobile Application (the App) is comprised of various interfaces operated by World Wide Activity, Inc, and doing business as Daily Doubloons™. Daily Doubloons™ is offered to the User, hereby referred to as You, conditional on your acceptance without modification, of the terms, conditions, and notices contained herein, hereby referred to as the Terms. Your use of the Daily Doubloons™ App constitutes your agreement to all such Terms. Please read these terms carefully and retain a copy of them for your records and reference.
The Daily Doubloons™ mobile application is a geocaching-style real treasure hunt app.
The purpose of the Daily Doubloons™ mobile application is to hide real valuables for Players to locate either virtually through a device, or live, at a physical location.
By their very nature, Daily Doubloons™ does not accept any responsibility or liability if there are affiliates, Users, Hosts, Players or advertisers that carry offensive, harmful, inaccurate or otherwise inappropriate material, or in some cases harmful, misleading, unclean, pornographic, sexual, or racist harmful postings, or fraudulent actions that are otherwise deceptive or cause harm or problems to Users, Hosts, and Players in using the Daily Doubloons™ App. Use at Your own discretion. Daily Doubloons™ reserves the right to remove or restrict access to any content that violates our policies. Users can report inappropriate or unsafe content directly via the app (main menu) or to our support team by sending an email to kaystucki@dailydoubloons.com . We review such reports promptly to ensure a safe experience for all users.
We, as Daily Doubloons™ and our parent company, World Wide Activity, Inc., expect that You, as a User, will exercise caution, exercise sound and proper judgement, and common sense when using the Daily Doubloons™ Mobile App. Daily Doubloons™ does not endorse, support, represent, or guarantee the truthfulness, accuracy, or reliability of any communications posted via the Service, advertising treasure hunts posted, or endorse any opinions expressed via the Advertiser or Host(s). You, as the User, acknowledge and understand that any released or posted clues or any material posted via the Daily Doubloons™ Mobile App will be at your own risk as you host treasure hunts, or try to solve or search for clues as posted by Hosts on the Daily Doubloons™ Mobile App. We invite Daily Doubloons™ Affiliates, Hosts, Players, Users, and Advertisers to protect, and inform Daily Doubloons™, the Daily Doubloons™ Mobile App or our parent company World Wide Activity, Inc., of any infractions, improper use, unsafe or fraudulent practices, to help keep the treasure hunts clean and safe for all.
Please follow these general rules while searching for Treasures, or while hiding Treasures. Be creative and hide treasure in hard to find, or easy to find places. However, take care not to bury treasure deep. Do not dig holes below 3-6 inches deep. Respect private property and protected public areas, such as wildlife preserves, parks and underwater habitats. If treasure is hidden underwater, or in other conditions or area that are outside normal, common venues, use wisdom and consideration, particularly if clues or directions indicate that treasures may require you to be scuba certified or otherwise qualified to obtain them. Do not hide treasures in or around water that is dangerous in any way. Always use precautions and safety around any body of water, or around mountainous or other similar terrain. If you are not comfortable with the terrain, do not hide treasures there. Similarly, if you are not comfortable with the terrain, do not hunt for treasures there. Do not deposit or hide treasures in trash bins, or containers, large or small, or in other refuse containers or receptacles. Do not hide treasure in or near roadways, or near areas known for adverse traffic conditions, or areas with heavy traffic, near intersections, electrical stations, parking lots or roundabouts. Do not hide treasure down back alleys, streets or in any areas of town, city or country that may be unsafe or hazardous. Similarly, do not search for treasure in or near roadways, or near areas with traffic, intersections, electrical stations, parking lots or roundabouts. When placing treasure, or searching for treasure, take proper precautions when in places that require climbing, or could cause falls or injuries. Avoid train tracks, railways and switchyards, and other similar areas. Protect vegetation and animals both when hiding treasure, and when hunting for treasure. Be aware of animals in the vicinity, and both be kind, and follow proper safety procedures when in locations. If you move anything, try to put it back the best you can. Follow the principles of “Leave No Trace” Always obey all laws and ordinances, especially curfews, park hours, and other safety related ordinances. Be respectful to others, their property and other Daily Doubloons™ Players.

User Discretion

You, as a User, acknowledge and understand that any Hosts posting treasure hunts, and Players hunting for treasure via the Daily Doubloons™ Mobile App, will be at your own risk, and under your own responsibility. If clues seem to be leading you into unsafe locations or areas that you do not feel comfortable with, do not follow those clues. We invite all Daily Doubloons™ Affiliates, Hosts, Players, Users, and Advertisers to police the Daily Doubloons™ mobile App for infractions, bad usage, fraudulent or unsafe usage, and/or Hosts that do not provide the treasure promised. Help keep the treasure hunts clean, safe and fun for all. We wish you happy treasure hunting, creating, and especially encourage you to have fun in the search. Enjoy the outdoors and treasure hunt everywhere from the park to the beach, to the mountains, forests or desert. Also, enjoy treasure hunting in the Daily Doubloons™ App itself, on Virtual treasure hunts. The Treasure is in the Hunt! And the hunt is in the App!

Indemnity

You, as a User, acknowledge and understand that any Host posting treasure hunts, and Players hunting for treasure via the Daily Doubloons™ Mobile App will be at your own risk and responsibility. You will indemnify and hold harmless Daily Doubloons™ and our parent company World Wide Activity, Inc., and will exempt Daily Doubloons™ and/or World Wide Activity, Inc., from legal liability. You promise you will not sue Daily Doubloons™ or World Wide Activity, Inc., for any reason whatsoever. You will indemnify, and hold harmless Daily Doubloons™ and World Wide Activity, Inc., and our affiliates and subsidiaries, and the respective officers, directors, employees, and agents of these companies, from any claim or demand, including reasonable legal fees, loss or other financial burdens made by any third party arising out of, or related to your content, advertising, your breach of these Terms of Service, your participation in and/or improper use of the Marketing Service or your breach of any law or the rights of a third party. Partners are intended third party beneficiaries of this section.

General

Daily Doubloons™ reserves the right in its sole discretion to suspend, terminate or restrict your use of the Marketing Service, without notice, for any or no reason, and without liability to you or any third party. In all cases, the running of any campaigns after suspension or termination is in Daily Doubloons™ sole discretion. Daily Doubloons™ also reserves the right to modify, suspend or discontinue parts of the Marketing Service or the Marketing Service as a whole.
You as a Daily Doubloons™ Host or Player participating in the use of the website or Daily Doubloons™ App, its application and physical and virtual hunting will indemnify and hold harmless Daily Doubloons™ and World Wide Activity, Inc., and their employees, officers, directors, Hosts, partners, and sponsors, etc., harmless of any claim, demand, including reasonable legal fees, made by third parties related to, or arising from your content or any other content or liability. You agree that you will not sue or make any legal claims, damages or hold Daily Doubloons™ or our associates responsible in any way for any possible injury or harm made to you, or anyone associated with or accompanying you, as you participate in any treasure hunt that may have accrued any damages whatsoever as a result of any hunt. You agree not to hold Daily Doubloons™ liable for any claims, sue for any damages, expenses, injuries, sickness, harm, loss of life, limbs or any damage whatsoever. You understand the term: Buyer Beware, as it applies to you as a User of the Daily Doubloons™ App, and that you, as a User, must use regular common sense, and take your own necessary safety precautions, and you understand that you, as a Host or a Player, are hiding treasures, or searching for treasures using the Daily Doubloons™ App entirely at your own risk. Daily Doubloons™ reserves the right, at our sole discretion, to terminate, restrict, suspend, discontinue parts of our marketing, or restrict your use thereof, without notice. Daily Doubloons™ reserves the right to suspend, restrict, modify, update, or otherwise change the Daily Doubloons™ Mobile App, and takes no responsibility, expressed or implied. There is no refund whatsoever for any Host’s treasure hunt that has been posted to the public, or to any individual or business, either as an Exclusive Doubloons, Open Doubloons or Virtual Doubloons.

Privacy

Your use of the Daily Doubloons™ App is subject to the Daily Doubloons™ Privacy Policy. Please review our Privacy Policy, which governs the Daily Doubloons™ App, and informs users of our data collection practices.

Electronic Communications

Using the Daily Doubloons™ App, sending emails, or digital communications of any kind to Daily Doubloons™ constitutes electronic communications. You, as a User, consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we, as Daily Doubloons™, provide to you electronically, via email, notifications and on the Daily Doubloons™ App, satisfy both parties™ consent.

Your Account

If you use the Daily Doubloons™ App, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your device alone. You accept responsibility for all activities that occur under your account and password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Daily Doubloons™ is not responsible for third party access to your account that results from theft or misappropriation of your account. Daily Doubloons™ and its associates reserve the right to refuse or cancel service or subscriptions, terminate accounts, or remove and/or edit content at our sole discretion.

Minors

Daily Doubloons™ does not knowingly collect, either online or offline, personal information from persons under the age of eighteen. If you are under the age of 18, you may use the Daily Doubloons™ App only with the permission of a parent or guardian. Use of the Daily Doubloons™ App constitutes consent to these terms and can be considered agreement that minor persons only use the Daily Doubloons™ App with the express permission and agreement of their parent/guardian.

Cancellation/Refund Policy

You may cancel any Daily Doubloons™ purchased treasure hunt at any time before the initiation of the event, at the scheduled date and time. All Sales are Final once any Daily Doubloons™ purchased treasure hunt is labeled as Active or has been initiated.

Software Usage

Daily Doubloons™ and World Wide Activity, Inc., provide software on the terms and conditions set forth in this License. All Users, Players, and Hosts, hereby known as You and Your, by Your use of this software, accept these terms and conditions, and agree to comply with them. In addition, by using the software You:
A. Represent and warrant that You are not an employee of Daily Doubloons™ or World Wide Activity, Inc.
B. Agree that You are legally bound by this License for the use of this Software.
C. Represent and warrant, as applicable, that You are either
    i. an individual of legal age to enter into a binding agreement and are using this software either for Your personal enjoyment or your own individual business purposes, or
    ii. an individual acting not for your own individual business purposes, but as an employee, officer, agent or other duly authorized representative of a legally existing partnership, limited partnership, limited liability company, corporation, governmental entity, or other organization authorized to act and to conduct business in all jurisdictions in which You (meaning, in this case, both You individually, and the organization(s) that You represent) use the software and conduct business using the software, and
    iii. with respect to all businesses and organizations, you (meaning the business and the individual accepting this License) are duly authorized to act for You (the business or other organization) and to bind both of You to this License.

Background

This and any third party software and documentation accompanying this License, whether on disk, in read-only memory, on any other media, or in any other form (collectively, the software) are licensed, not sold, to you by Daily Doubloons™, and World Wide Activity, Inc, for use only under the terms of this License. We retain the ownership of the software itself, and reserve all rights not expressly granted to You.

Daily Doubloons™ is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Daily Doubloons™ of the site, or any association with its operators.
Certain services made available via the Daily Doubloons™ App are delivered by third party sites and organizations. By using any product, service, or functionality originating from the Daily Doubloons™ App, you hereby acknowledge and consent that Daily Doubloons™ may share such information and data with any third party with whom Daily Doubloons™ has a contractual relation to provide the requested product, service or functionality on behalf of the Daily Doubloons™ App users and customers.

No Unlawful or Prohibited Use/ Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Daily Doubloons™ App, strictly in accordance with these Terms of Use. As a condition of your use of the Daily Doubloons™ App, you certify to Daily Doubloons™ that you will not use the Daily Doubloons™ App for any purpose that is unlawful or prohibited by these Terms. You may not use the Daily Doubloons™ App in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Daily Doubloons™ App. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Daily Doubloons™ App.
All content included as a part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Daily Doubloons™ App, is the property of Daily Doubloons™ or it’s suppliers and is protected by copyright and other laws pertaining to and protecting intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, limitations or other restrictions contain in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale of, create derivative works, or in any way exploit, any of the content, in whole or in part, found on the Daily Doubloons™ App. Daily Doubloons™ content is not for resale. Your use of the Daily Doubloons™ App does not entitle you to any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written consent and permission of Daily Doubloons™ and the copyright owner. You agree that you do not acquire any ownership rights of any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Daily Doubloons™ or our licensors, except as expressly authorized by these Terms.

Intellectual Property Rights

Title and Intellectual property rights in and to any content displayed by or accessed through the software belongs to the respective content owner. Such content may be protected by copyright or other intellectual property laws and treaties and may be subject to terms of use of the third party providing such content. This License does not grant you any rights to use such content, nor does it guarantee that such content will continue to be available to you. We reserve all rights to all our names and intellectual property, including but not limited to, the name Daily Doubloons™ and Our brands, logos, trademarks, and variations of such names, brands, logos and trademarks.

Limited, Non-Exclusive License

Subject to the Terms and Conditions of this License, you are granted a limited, non-exclusive license to install and use the software. To the extent that the software may be used to reproduce materials, such use is limited to reproduction of non-copyrighted materials, materials in which you own the copyright, or materials you are authorized to, or legally permitted to reproduce. You may not make the software available over a network where it could be used by multiple computers at the same time. You may make one copy of the software in machine-readable form for backup purposes only, provided that the backup copy must include all copyright or other proprietary notices contained in the original.

Reverse Engineering:
You may not, and you agree not to, or to enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the software or any services provided by the software, or any part thereof; except as, and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of Open-Sourced Components that may be included with the software.

Transfer

You may not rent, lease, lend, redistribute or sublicense the software. You may, however, make a one-time permanent transfer of all your license rights to the software to another party, provided that: (a) the transfer must include all of the software, including all its component parts and this License; (b) you do not retain any copies of the software, full or partial, including copies stored on a computer or other storage device; and (c) the party receiving the software reads and agrees to accept the terms and conditions, without modification, in their entirety.

Open Source; Non-Liability of Actions of Others

This software functions as an open source, multi-signature digital, multi-use Phone Application. The software is not, nor do we, as Daily Doubloons™, or World Wide Activity, Inc., provide or act as, an account, an account holder, an account servicer, a financial intermediary, or a custodian of anything having monetary value. While You, the User, or other Hosts or Users may offer or provide treasures or prizes to other Users or Players who participate in treasure hunts, We are not responsible for the hunts, clues, treasures, prizes, representations, marketing, advertising, organization, compliance, non-compliance, or other actions or inactions of any Host, Player, User of any other person using or applying the software for his, her, or its purposes. In no event will We, as Daily Doubloons™ or World Wide Activity, Inc., our affiliates, or our service providers, be liable to You, as the User, or to any other third party for any use, action, representation, deception, or other bad faith dealing by You, or by any other User, Host or Player using this software.

Use of Communication Services

The Daily Doubloons™ App may contain bulletin boards, services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, Communication Services). You, as the User, agree to use the Communication Services only to post, send and receive messages and materials that are proper and related to the particular Communication Service.
You agree that when using a Communication Service, you will not: defame, abuse, harass, stalk, threaten or otherwise violate the legal rights, such as rights of privacy and publicity, of others. You agree that you will not: publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topic, name, material or information. You agree that you will not: upload files that contain software or other material protected by intellectual property laws, or by rights of privacy or publicity, unless you own or control the rights thereto, or have received all necessary written consents. You agree that you will not: upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s device, or the Communications Services of the Daily Doubloons™ App, or our affiliates, partners or service providers. You agree that you will not: advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages. You agree that you will not: conduct or forward surveys, contests, pyramid schemes or chain letters. You agree that you will not: download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner. You agree that you will not: falsify or delete any other attributions, legal or other proper notices or proprietary designation or labels of the origin or source of software or other material contained in a file that is uploaded. You agree that you will not: restrict or inhibit any other user from using and enjoying the Communication Service, nor will you harvest or otherwise collect information about others, including but not limited to e-mail addresses, without the express written consent of the owners; nor will you violate any of the applicable laws or regulations as set forth in these Terms and Conditions.
Daily Doubloons™ has no obligation to monitor the Communication Services. However, Daily Doubloons™ reserves the right to review materials posted to a Communication Service, and to remove any materials at its sole discretion. Daily Doubloons™ reserves the right to terminate your access to any or all of the Communication Services at any time with or without notice, for any reason whatsoever, following the violation of any of the policies set forth in this Licensure Agreement.
Daily Doubloons™ reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post, or to remove any information or materials, in whole or in part, at Daily Doubloons™ sole discretion.
Always use caution when giving out personal identifying information about yourself or any minor persons using the Daily Doubloons™ App with your consent, on any Communication Service. Daily Doubloons™ does not control, or endorse the content, messages or information found in any Communication Service and therefore, Daily Doubloons™ specifically disclaims any liability with regard to the Communication Services, and any, and all, actions resulting from your participation in any Communication Service. Managers and Hosts are not authorized Daily Doubloons™ spokespersons, and their views do not necessarily reflect those of Daily Doubloons™.
Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

Materials Provided to the App, or Posted

Daily Doubloons™ does not claim ownership of the materials you provide to the Daily Doubloons™ App, including feedback and suggestions, or post, upload, input or submit to any Daily Doubloons™ App or our associated services (collectively, Submissions). However, by posting, uploading, inputting, providing, or submitting your Submission, you are granting Daily Doubloons™, our affiliated companies and necessary sublicensees, permission to use your Submission in connection with the operation of their Internet businesses, including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.
No compensation will be paid with respect to the use of your Submission, as provided herein. Daily Doubloons™ is under no obligation to post or use any Submission you may provide, and may remove any Submission at any time, at Daily Doubloons™ sole discretion.
By posting, uploading, inputting, providing or submitting your Submission, you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submission(s).

Third Party Accounts

You will be able to connect your Daily Doubloons™ account to third party accounts. By connecting your Daily Doubloons™ account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others, in accordance with your privacy settings on those third-party sites. If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Services are controlled, operated and administered by Daily Doubloons™ from our offices, and distributed through the Apple App Store, and Google Play Store internationally. If you access the Service from a location outside the United States of America, you are responsible for compliance with all local, and U.S. laws. You agree that you will not use the Daily Doubloons™ content accessed through the Daily Doubloons™ App in any country, or in any manner prohibited by any applicable laws, restrictions or regulations. Usage of the Daily Doubloons™ App constitutes acceptance and agreement to these terms, and Daily Doubloons™ cannot be held liable for your usage of the Daily Doubloons™ App in ways contrary to the applicable laws, restrictions and/or regulations.

Indemnification

You, as a User, agree to indemnify, defend and hold harmless Daily Doubloons™, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and/or expenses, including reasonable attorney’s fees, relating to you, or arising out of your use of, or inability to use, the Daily Doubloons™ App or Services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Daily Doubloons™ reserves the right, at its own cost, to the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Daily Doubloons™ in asserting any available defenses.

Disclaimer of Warranties

If you are a customer who is a consumer (someone who uses the software outside of your trade, business or profession), you may have legal rights in your country of residence which would prohibit the following limitations from applying to you; and where prohibited they will not apply to you. To find out more about these rights, you should contact a local consumer advice organization.
You expressly acknowledge and agree that, to the extent permitted by applicable law, use of the software/app/website and any services performed by or accessed through the software is at your sole risk, and that the entire risk as to satisfactory quality, performance, accuracy and effort lies with you.
To the maximum extent permitted by applicable law, the software and services are provided As Is and As Available , with all faults and without warranty of any kind; and we, the licensors (collectively referred to as We for the purposes of this and the following sections) hereby disclaim all warranties and conditions with respect to the software and services, either express, implied or statutory; including, but not limited to, the implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third party rights.
We do not warrant against interference with your enjoyment of the software and services, that the functions contained in, or services performed or provided by, the software will meet your requirements, that the operation of the software or services will be uninterrupted or error-free, that any services will continue to be made available, that the software or services will be compatible, or work with any third party software, applications or third party services, or that defects in the software or services will be corrected. Installation of this software may affect the availability and usability of third-party software, applications or third party services, as well as our products and services.
You further acknowledge that the software and services are not intended or suitable for use in situations or environments where the failure of, or time delays of, or errors or inaccuracies in, the content, data or information provided by the software or services could lead to death, personal injury, or severe physical or environmental damage; including without limitation, the operation of nuclear facilities, aircraft navigation, or communications systems, air traffic control, life support or weapons systems.
No oral or written information or advice given by us or our authorized representative shall create a warranty. Should the software or services prove defective, you assume the entire cost of all necessary servicing, repair or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusions and limitations do not apply to you.

Limitation of Liability

To the extent no prohibited by applicable law, in no event shall we be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, corruption or loss of data, failure to transmit or receive any data or information, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use, the software or services, or any third party software or applications in conjunction with the Software or Services, however caused, regardless of the theory of liability (contract, tort or otherwise), and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for personal injury, or of incidental, or consequential damages, so this limitation may not apply to you.
In no event shall Our total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of twenty five U.S. dollars ($25.00). The foregoing limitations will apply, even if the above stated remedy fails of its essential purpose.

Compliance with Law

You agree to comply with all applicable state, federal, local, and international laws in your use of the software.

Responsibility for Passwords, Personal Information

You are solely responsible for safekeeping and maintaining your passwords, private key pairs, PINS, and any other codes or credentials you may use to access, use or protect the software, and your data used in connection with the software.

Right to Collect Information for Mega-Treasure Hunts

You recognize and agree that Daily Doubloons™, and our parent company World Wide Activity, Inc., (hereafter known as We ) may record and accumulate your name, image and contact information if you are a winner of any treasure hunt conducted using the software for the purpose of conducting and publicizing mega treasure hunts, as described from time to time through the software; including drawings for opportunities to participate in mega-treasure hunts, the actual orchestration of such mega- treasure hunts, and the recognition of participants and winners of such mega treasure hunts.

Applicable Law

This License, and its application and interpretation thereof, shall be governed exclusively by the laws of the United States of America, and of the State of Idaho, without regard to its or their conflict with, or choice of law rules. By using this software, You consent to the exclusive jurisdiction of the courts of the State of Idaho for any dispute arising under this License, or regarding the software, and to venue for any such legal action in Jefferson County, Idaho.

Severability

If any portion of this License is determined void, invalid, or unenforceable, such determination shall not affect any portion of the remainder of this License, and all other parts, portions, and paragraphs of this License shall remain in full force and effect according to its, and their, terms.

Binding Agreement

The Terms and Provisions of this License are binding upon You, your heirs, successors, assigns, executors, personal representatives, and any other person or entity claiming by or through You. If you are an organization, business or legal entity, including a governmental entity, this License also binds your directors, owners, shareholders, partners, employees, agents and representatives.

Modification of Software and License

We reserve the right, at any time, with or without notice, to modify the software, amend this License, change the rules, create other options and upgrade the software. By continuing to use the software after any such modification, amendment, change or upgrade, You consent to the modified terms and conditions of this License as they apply to the new and/or modified software, License, rules and options.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of, or concerning these Terms and Conditions, or any provision hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator, and administered by the American Arbitration Association or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the even that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney™s fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions, or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly. The entire dispute shall be determined by the Arbitrator.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrators and class/representative/collective actions are not permitted. The parties agree that a party may bring claims against the other, only in each’s individual capacity, and not as a plaintiff or class member in any putative class, collective and/or representative proceeding, such as in the form of a private attorney general action against the other. Further, unless both You, and the Daily Doubloons™ party agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

The information, software, products and services included in or available through the Daily Doubloons™ App may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Worldwide Activity, Inc., and/ or its suppliers may make improvements and/or changes in the Daily Doubloons™ App at any time.
World Wide Activity, Inc., and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics contained in the Daily Doubloons™ App for any purpose. To the maximum extent permitted by the applicable law, all such information, software, products, services, and related graphics are provided As Is without warranty or condition of any kind. World Wide Activity, Inc., and/or its suppliers hereby disclaim all warranties and conditions about this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.
To the maximum extent permitted by applicable law, in no event shall World Wide Activity, Inc., and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages, or for any damages whatsoever, including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Daily Doubloons™ App, with the delay or inability to use the Daily Doubloons™ App or related services. Nor shall World Wide Activity, Inc., and/or its suppliers be liable for the provision of or failure to provide services, or for any information, software, products, services, or related graphics obtained through the Daily Doubloons™ App, whether based on contract, tort, negligence, strict liability or otherwise, even if World Wide Activity, Inc., has been advised of the possibility of damages. Because some states and/or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any features of the Daily Doubloons™ App, or with any of these terms of use, rights of conduct, rules of use, or limitations, your sole and exclusive remedy is to discontinue use of the Daily Doubloons™ App.

Changes to Terms

Daily Doubloons™ reserves the right, at its sole discretion, to change the Terms under which the Daily Doubloons™ App is offered. The most current version of the Terms and Conditions will supersede all previous versions. Daily Doubloons™ encourages You, as the User, to periodically review the Terms and Conditions to stay informed of our updates.

Upgrades or Updates

We, at our discretion, may make available future upgrades or updates to the software for your computer or other device. Upgrades and updates, if any, may not necessarily include all existing software features or new features that We release for newer, or other models, of computer or device. The Terms of this License will govern any software upgrades or updates provided by Us that replace and/or supplement the original software product, unless such upgrade or update is accompanied by a separate License, in which case the terms of that license will govern.

Termination/ Access Restriction

Daily Doubloons™ reserves the right, at its sole discretion, to terminate Your access to the Daily Doubloons™ App and the related services or any portion thereof, at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Idaho, and You, as the User, hereby consent to the exclusive jurisdiction and venue of courts in Idaho in all disputes arising out of our relation to the use of the Daily Doubloons™ App. Use of the Daily Doubloons™ App in unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment or agency relationship exists between You and Daily Doubloons™ as a result of this agreement or use of the Daily Doubloons™ App. Daily Doubloons™ performance of this agreement is subject to existing laws and legal procedures, and nothing contained in this agreement is in derogation of Daily Doubloons™ right to comply with governmental, court and/or law enforcement requests or requirements relating to your use of the Daily Doubloons™ App, or information provided to or gathered by Daily Doubloons™ with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable laws, including, but limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the User and Daily Doubloons™ with respect to the Daily Doubloons™ App, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and Daily Doubloons™ with respect to the Daily Doubloons™ App. A printed version of this agreement and of any notice given in electronic format shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement, to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed or digital format. It is the express wish to the parties that this Agreement, and all related documents be written in English.

Termination

This License is effective until terminated. Your rights under this License will terminate automatically without notice from Daily Doubloons™ or World Wide Activity, Inc., if You fail to comply with any term(s) of this License. Upon termination of this License, you must cease all use of the software and destroy all copies, full or partial, of the software.

Rules of Use

By using this software, you also agree to comply with all the Rules of Use of the Daily Doubloons™ software as separately set forth as part of the software application. Your continued use of this software denotes that you have read this document and these Terms and Conditions in their entirety, and that you agree to abide by any, and all, rules provisions, terms, stipulations and conditions contained herein. Thank you for using our Daily Doubloons™ App. The Treasure is in the Hunt!
